The following are the Terms and Conditions for trading through this Islay Wildscapes website online shop. These have been provided to give you confidence in purchasing items from this site. By purchasing items from the Islay Wildscapes Online Shop you agree to the following Terms and Conditions. This is to comply with the European Union (EU) Directive on Distance Selling.
Statutory Rights: Your statutory rights are not affected by any clause in these Terms and Conditions.
Place of performance and applicable law
Islay Wildscapes is the shop front of Teresa Morris, Sole Trader as a Wildlife and Landscape Photographer. The items for sale on this site are directed solely at those who access this site from the United Kingdom. Those who choose to access this site from other locations are responsible for compliance with local laws if and to the extent local laws are applicable. You the purchaser and Teresa Morris each submit to the exclusive jurisdiction of the English Courts in relation to disputes arising from the purchase of goods from this website.
Placement of an order
Goods supplied to you will correspond to their prices and descriptions as stated on the Islay Wildscapes website at the time of ordering. If at any time this is not the case, Islay Wildscapes will give you the right to reject the goods within a reasonable time period for a full refund. In the unlikely event that an incorrect price is shown on the website. Islay Wildscapes reserves the right to abstain from fulfilling the order at that price. You will be notified by email and at which point you will be informed of the correct price and given the choice to proceed with the order.
Application of Value Added Tax (VAT) Islay Wildscapes is not VAT registered therefore no VAT is added to the items for sale.
Guarantee of Quality Islay Wildscapes guarantees that goods are of high quality and meet the required standards for the purpose they were intended.
Payment Options and Security: Islay Wildscapes, Teresa Morris accepts online payment through PayPal which enables “fast easy and secure online payments” (PayPal). No PayPal account is required for buyers. PayPal payments method accepts debit, credit, PayPal balance payment methods. PayPal is Payment Card Industry Data Security Standard (PCI DSS) compliant. Delivery/despatch times: All items are made to order. Greeting and Christmas Cards, A4 Colour Prints and Jigsaws will be dispatched within 7 to 14 days of receipt of payment and confirmation of order whichever is the latest. Canvas Prints will be dispatched within 14 to 28 days of receipt of payment and confirmation of order whichever is the latest.
Postage and packaging to United Kingdom postal addresses is charged at cost and is included in the price of the goods specified in the online shop.

For delivery outside of the United Kingdom please contact islaywildscapes@aol.com with a list of items you wish to purchase before ordering as postage costs will vary.
Responsibility for local taxes and duties: These are the responsibility of the shopper or recipient in the country of destination.
Retention of Title: This remains with Islay Wildscapes until the goods are paid for in full.
Confirmation of order: Upon submitting an order using the PayPal shopping cart you will receive a confirmation of the items ordered and payment reference number from PayPal. It is important that you retain this. Islay Wildscapes will receive notification from Paypal of your order. Following receipt of this Islay Wildscapes will email you as soon as possible with a confirmation of your order, with an order reference number and indication of despatch date. This is not an invoice. Upon receipt please check to ensure the correct items have been ordered. If there are any mistakes please email immediately to islaywildscapes@aol.com to rectify any error.
At the time an order is dispatched you will receive an email from Islay Wildscapes confirming the dispatch date and Royal Mail Tracking number where relevant. An invoice will follow by post with the goods.
In the unlikely event of Islay Wildscapes being unable to fulfil an order placed you will be notified by email as soon as possible. If payment has been made on an order that has been unable to be fulfilled Islay Wildscapes will immediately refund payment to you through PayPal.
Substitutions: Whilst every effort is made to supply the items as requested, the contents of an order are subject to availability. Islay Wildscapes reserves the right to substitute items of similar or higher value, where appropriate should the need arise. Under these circumstances you have the option to accept or decline the substitute goods.
Returns Policy
Cancellation Policy You have the right to cancel your purchase at any time either before or up to 7 days following the day you receive the goods by emailing Islay Wildscapes at islaywildscapes@aol.com stating your name, a description of the goods concerned and the date and order number of the cancelled order.
If you exercise your right to cancel your order after the goods have been despatched, you will be responsible for returning the goods to Islay Wildscapes at your own risk and cost, therefore you are recommended to use an insured delivery method such as Royal Mail. All returns are subject to the following conditions except where the goods are faulty or incorrectly described on the website.
Your goods must be complete and in “as new” condition (there should be no marks or damage to the goods and it must not have been used). A proof of purchase must be supplied. Islay Wildscapes will not refund any items that have been specially ordered to your individual specification or personalised. Goods returned outside the 7 days cancellation period (but within 28 days of receipt) that cannot be sold as new will only be refunded to their mail order return value and a credit note may be issued.
Where Islay Wildscapes have made a charge for postage this will be deducted from your refund if the goods have been dispatched to you. The refund will be made to you by the same means with which you made the payment through PayPal within 30 days from the cancellation date.
You cannot cancel your purchase when the goods are a special order to your specification, or 28 days has lapsed following receipt of the goods. Until such time you return the goods to Islay Wildscapes you must take reasonable care of the items and not use them. Any use of the goods upon delivery will invalidate your right to cancel the contract.
Authorising the return of goods You must prior to returning any goods received contact Islay Wildscapes
at islaywildscapes@aol.com stating your name, a description of the goods concerned and the date and
order number of the cancelled order. You must have received an email confirmation with a returns number
from Islay Wildscapes before posting. If you fail to do this your refund will be delayed or the product will be
returned to you.
All authorised returns must be returned stating the returns authorisation number to

Islay Wildscapes makes every effort to ensure goods arrive in perfect condition. However in the unlikely event of a product not being delivered within 10 working days of despatch customers should advise by email islaywildscapes@aol.com Islay Wildscapes will make every effort to locate the goods and if necessary send a replacement at their expense or provide a full refund. If goods arrive damaged in any way, customers should contact Islay Wildscapes by email info@islaywildscapes.co.uk within 7 days of receipt. This does not affect your statutory rights as a consumer.
Faulty goods You have an option to request an exchange or refund if the fault occurs within 28 days of delivery. Within 12 months Islay Wildscapes will offer an exchange or (full or partial) refund. In all cases Islay Wildscapes reserves the right to inspect the product and verify the fault and if no fault is found return the product to you. No refund or exchange will be processed until Islay Wildscapes has received the returned goods and an appraisal of the fault made. This does not cover faults caused by accident, neglect misuse or normal wear and tear.
Refunds for valid claims will be made via the same method of payment through PayPal as used to place the order. Any refund due to a fault or other defect will include a refund of the delivery charge.

Unforseen Circumstances Islay Wildscapes shall not be held liable for any breach of these terms caused by circumstances out of its control, but not limited to Acts of God, fire, lightening, flood, extremely severe weather, war, disorder, industrial disputes, acts or omissions of internet services providers or acts of central government or other competent authorities.
